By accessing this website, we assume you accept these terms and conditions. Do not continue to use House of Indah if you do not agree to take all of the terms and conditions stated on this page.

This document is an electronic record under Information Technology Act, 2000 and rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes under applicable Indian laws. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published and shall be construed in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and user agreement for access or usage of https://houseofindah.in website.

This Agreement shall begin on the date this terms and conditions have been published.

User Agreement

Your use of https//www.houseofindah.in and all the web-pages, hyper-links, tools and services provided thereunder (hereinafter referred to as "the Website" which expression shall include any successor or replacement website(s)) is governed by the following terms and conditions as applicable to the Website ("User Agreement"). This User Agreement shall come into effect upon each visit or usage of the Website, or upon your registration, or upon you providing any information on the Website. In this User Agreement, you are contracting with House Indah, a company incorporated under Companies Act, 1956 with its registered office at  Gomti Nagar, Lucknow- 226010., hereinafter referred to as "the Platform" which expression unless the context otherwise require shall mean and include its successors, liquidators and assigns.

For the purpose of the User Agreement, "Registered User", "Visitor", and wherever the context may so require, "You" shall mean any natural or legal person who has agreed to become a member of the Website by providing Registration Data (as defined hereinafter) while registering on the Website as a Registered User using the computer systems of the Website, or who has used the Website without becoming a Registered User, and, in both the cases, accepted this electronic version / electronic record of the User Agreement. A Registered User is one who has allocated himself a unique identification user name ("User ID" and "Password") to become Registered User. The term and expression "You" shall, unless the context otherwise requires, include your legal heir, receivers, successors, liquidators and permitted assigns.

As a Registered User, this User Agreement shall be effective and binding upon your 'acceptance'. "Acceptance" shall mean your affirmative action in clicking on the 'check box' and/or on the ‘continue’ button and/or or any affirmative action as provided on the registration page or using or accessing the Website through logging in by Your third party website user ID and password, including that of www.facebook.com, websites owned by Yahoo Inc. or its subsidiaries, Google Inc. or its subsidiaries, Twitter or any other social media website as permitted on the Website or generally using the Website in any manner, with or without using Your User ID and Password. If you do not agree or are not willing to be bound by the terms and conditions of this User Agreement, please do not click on the ‘check box’ or on the ‘continue’ button or any other button and do not seek to obtain access to or otherwise use the Website.

Amendments to the User Agreement

The Platform may amend this User Agreement at any time by posting a revised version on the Website. The revised version will be effective at the time Platform posts it on the Website. You are advised to regularly check for any amendments or updates to the terms and conditions contained in this User Agreement.

License:

Unless otherwise stated, House Indah and/or its licensors own the intellectual property rights for all material on House of Indah. All intellectual property rights are reserved. You may access this from House of Indah for your own personal use subjected to restrictions set in these terms and conditions.

You must not:

• Copy or republish material from House of Indah
• Sell, solicit, rent, or sub-license material from House of Indah
• Reproduce, duplicate or copy material from House of Indah
• Redistribute content from House of Indah
• Use the Services to advertise or offer to sell goods and services.
• Sell or otherwise transfer your profile.
• Solicit this website or any product displayed in any other name

Warranty 

You warrant and represent that:

• You are entitled to post the comments, if allowed on our website and have all necessary licenses and consents to do so;
• The Comments do not invade any intellectual property right, including without limitation copyright, patent, or trademark of any third party;
• The Comments do not contain any defamatory, libelous, offensive, indecent, or otherwise unlawful material, which is an invasion of privacy.
• The Comments will not be used to solicit or promote business or custom or present commercial activities or unlawful activity.
• You hereby grant House Indah a non-exclusive license to use, reproduce, edit and authorize others to use, reproduce and edit any of your Comments in any and all forms, formats, or media.

• Social media websites including but not limited to Instagram, Facebook, WhatsApp, etc.

If you are one of the organizations listed in paragraph 2 above and are interested in linking to our website, you must inform us by sending an e-mail to House Indah. Please include your name, your organization name, contact information as well as 

the URL of your site, a list of any URLs from which you intend to link to our Website, and a list of the URLs on our site to which you would like to link. Wait 2-3 weeks for a response.

Approved organizations may hyperlink to our Website as follows:

• By use of our corporate name; or
• By use of the uniform resource locator being linked to; or
• Using any other description of our Website being linked to that makes sense within the context and format of content on the linking party's site.

No use of House Indah's logo or other artwork will be allowed for linking absent a trademark license agreement.

Payment Facility

Platform may from time to time contract with third party payment service providers including banks to open nodal bank accounts under applicable Indian laws, to facilitate the payment between users i.e. buyers and sellers and for collection of Platform Fees and other charges. These third party payment service providers may include third party banking or credit card payment gateways, payment aggregators, cash on delivery or demand draft / pay order on delivery service providers, mobile payment service providers or through any facility as may be authorized by the Reserve Bank of India for collection, refund and remittance, as the case may be of payment or supporting the same in any manner.

Breach

Without limiting other rights and remedies, Platform may limit your activity, immediately remove your information or buys, or end your listing, warn other users of your actions, immediately temporarily/indefinitely suspend or terminate or block your membership, and/or refuse to provide you with access to the Website in the event, but not limited to:

If you breach the User Agreement or any terms or policies of the Website.

If your actions may cause legal liability for you, other users or Platform. Platform may at any time at its sole discretion reinstate suspended users. Platform reserves the right to recover any amounts due and owing by you to Platform and to take strict legal action including but not limited to a referral to the appropriate police or other authorities for initiating criminal or other proceedings against you.

E-coupon

The offer contained in the electronic communication ("E-Coupons") is made by us and is open to targeted https://houseofindah.in registered users ("Users"). These terms and conditions are in addition to the existing House of Indah Terms & Conditions. E-Coupons are also not offered to, and shall not be used by, such Users who under any statutory obligations are prohibited to use E-Coupons. E-Coupon is the property of House of Indah and House of Indah has the right to cancel the E-Coupons at will and at any time (including during the validity period of the E-Coupon) without giving any prior intimation to the User. E-Coupon is a privilege from the House of Indah and not a right or claim against the House of Indah. E-Coupons can also be cancelled in case the User is in violation of House of Indah Terms and Conditions.

User using the E-Coupons in any manner shall be deemed to have read, understood and accepted these terms and conditions.

The value and the mode of using the E-Coupon are mentioned in the electronic communication.

The validity of E-Coupon is subject to the condition that the User remains a registered user and is neither suspended nor in violation of House of Indah Terms & Conditions.

E-Coupons can be redeemed only on purchases made through https://www.houseofindah.in on those listings which provides for an option of E-Coupon payments. E-Coupons shall be invalidated in case of rejection of payment by House of Indah due to House of Indah’s risk containment measures.

One E-Coupon can be used only for one purchase irrespective of the value of such purchase and the unutilized or underutilized value of the E-Coupons shall be forfeited and the User cannot claim any benefit or a substitute E-Coupon in lieu of the same. The purchase value of the item in excess of the value of the E-Coupon shall be paid by the User along with using the E-Coupon.

E-Coupon carries no cash value and cannot be transferred, negotiated or sold and cannot be redeemed against cash. E-Coupons cannot be combined with any other coupons or any other offer or discounts or promotions.

Content Liability:

We shall not be held responsible for any content that appears on your Website. You agree to protect and defend us against all claims that are raised on your Website. No link(s) should appear on any Website that may be interpreted as libelous, obscene, or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third party rights.

Indemnity

You shall fully indemnify, keep indemnified, defend and hold harmless Platform and Platform's shareholders, subsidiaries, affiliates, third-parties and their respective shareholders, officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys' fees, made by any third party or penalty imposed due to or arising out of your breach of the User Agreement or any rules and policies contained herein, or your violation of any law, rules or regulations or the rights of a third party.

Limitation of Liability

In no event shall Platform or its affiliates and service providers be liable for any indirect, incidental, special, incidental, consequential, punitive or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses arising out of or in connection with the Website, its services or this agreement (however arising, including negligence or under torts or under public policy).

In addition to any limitation of liability and various disclaimers provided elsewhere in this User Agreement, Platform's entire liability and Your sole and exclusive remedy in any circumstance is limited to the following:

If You are a seller on the Platform: an amount of Platform Fees, if any, paid by You as seller on the Website to Platform for the transaction under dispute.

If You are a buyer: the Platform's entire liability and your sole and exclusive remedy in any circumstance is limited to exercise its reasonable efforts to enable to You get the refund of the product price from the seller on the Website.

Other than the aforesaid, Platform shall have no liability to You.

Reservation of Rights:

We reserve the right to request that you remove all links or any particular link to our Website. You approve to immediately remove all links to our Website upon request. We also reserve the right to amend these terms and conditions and its linking policy at any time. By continuously linking to our Website, you agree to be bound to and follow these linking terms and conditions.

Removal of links from our website:

If you find any link on our Website that is offensive for any reason, you are free to contact and inform us at any moment. We will consider requests to remove links, but we are not obligated to or so or to respond to you directly.

We do not ensure that the information on this website is correct. We do not warrant its completeness or accuracy, nor do we promise to ensure that the website remains available or that the material on the website is kept up to date.

House of Indah shall not be liable for any lost or stolen E-Coupon and E-Coupons once issued shall not be reissued.

To the maximum extent permitted by applicable law, we exclude all representations, warranties, and conditions relating to our website and the use of this website. Nothing in this disclaimer will:

Fabric And Printing Disclaimer

Product Properties / Wash Care/ Sizing

• Our products are made and handled by human hands involving various processes.
• There is bound to be variations in colour, finish and overall look.
• The colours you see on our website will depend on the accuracy of your monitor for which subtle variations must be acknowledged.
• Wash care instructions are displayed on our website under each product description.
• These wash / dry clean instructions must be followed very carefully.
• Please do not spray deodorant, mist or a perfume on the dress directly and avoid using one specially for Gold & Silver Prints.
• Each garment is draped and fitted differently. The fit depends on the cut, fabric and styling of each garment.
• Some will be fitted and some more relaxed. Our Sizing guide will help you make a decision based on your body size.
• We use premium fabrics for all our garments hand sourced by our team. All our prints are Hand-Blocked Printed and may marginally vary in each batch of print. All photographs are for representation purpose and are shot to try and look as close as possible to the original product ordered but may have marginal colour variations from the actual product.
• Slight difference in colour from the visible product image is possible.There are times when a camera or a computer monitor can't match perspective of an eye. Slight difference is unavoidable. 
• This product is handblock printed & vegetable dyed. The print might have slight irregularities in the motif & colours which results from the human involvement in the process & is a hallmark of handcrafted products.
• Since the fabric is dyed using natural, vegetable dyes, it may rub dry or bleed colour on coming in contact with water for the first time.
• Gad, Reikh and Datta Blocks :  The gad is carved in intaglio and is engaged to print large background figures which leaves very slight zig zag border effect on the fabric., while rekh and datta are carved in complete relief. Rekh blocks also mark the outlines of the motif.

 Governing Law

This User Agreement and all the rules and policies contained herein and any of Your usage of Website and Your dealings with Platform shall be governed and construed in accordance with the laws of India.

Arbitration

If any dispute arises between You and Platform during Your use of the Website or Your dealing with the Platform in relation to any activity on the Website, in connection with the validity, interpretation, implementation or alleged breach of any provision of the User Agreement and all the rules and policies contained herein, the dispute shall be referred to a sole arbitrator who shall be an independent and neutral third party identified by Platform. The Arbitration & Conciliation Act, 1996, shall govern the arbitration proceedings. The arbitration proceedings shall be in the English language. The place of arbitration shall be Lucknow, Uttar Pradesh. Your obligations to pay the Payment Fees shall not be suspended during the arbitration proceedings. 

General

• None of the provisions of the User Agreement shall be deemed to constitute a partnership or agency between You and Platform and You shall have no authority to bind Platform in any manner whatsoever nor shall Platform have any authority to bind you in any manner whatsoever. All the services provided by the Platform shall be as independent contractor and on principal to principal basis.
• If any clause of the User Agreement shall be deemed invalid, void or for any reason unenforceable, such clause shall be deemed severable and shall not affect the validity and enforceability of the remaining clauses of the User Agreement.
• This Agreement sets forth the entire understanding and agreement between You and Platform with respect to the subject matter hereof.
• In Platform's sole discretion, Platform may transfer its rights and obligations under this Agreement, assign this Agreement or novate this Agreement without your prior express consent. However, Platform on reasonable efforts basis and if practicable may provide You with an advance intimation of any such acts.
• You should be logged in as a Registered User of House of Indah.com in order to use and avail the benefits of the E - coupons which are mapped to your User ID. Orders without logged-in status maybe cancelled.
• The offers/E-Coupons/House of Indah Promotions are valid only for genuine customers who have received direct communication, in any form or manner, of such offer/E-Coupon/House of Indah Promotion. House of Indah reserves the right to cancel any orders placed by registered users using an E-Coupon, which is not directly communicated to the customer in any form or manner.
• House of Indah reserves the right, at its sole discretion, to decide whether a customer is/was eligible to use an E- Coupon or not for the order placed.
• An E- coupon can be used by a customer only once.
• Offer will not be applicable on certain items and gift cards, if applicable.
• House of Indah reserves the right, at its sole discretion, to exclude certain items from the Offers/E- Coupons/House of Indah Promotions offer, without prior intimation or communication.
• House of Indah reserves the right, at its sole discretion, to cancel any order where it suspects the misuse of E - Coupons by using unlawful, unethical means, incorrect user information/details, duplicate emails, mobile numbers or addresses. The decision of House of Indah will be final and binding in this respect.
• House of Indah reserves the right, at its sole discretion, at any time to amend/change the terms and conditions of any E - Coupons and/or House of Indah Promotions and/or offers provided thereunder.

Grievance Officer

This page is published and shall be construed in accordance with the provisions of Rule 3(11) of the Information Technology (Intermediaries Guidelines) Rules, 2011 ("IT Rules") that requires publishing the name of the Grievance Officer and his/her contact details on the website, such that users or any victim who suffers as a result of a violation of Rule 3 (outlined in our Privacy Policy and Terms of Use) by any other person, can notify their complaints to us.

Further, as per Rule 3(4) of the IT Rules, the Grievance Officer shall acknowledge or respond to Your communication of violation of Rule 3, by any other person, within 36 (thirty six) hours, and the complaints shall be redressed within 1 (one) month from the date of receipt of the complaint.
